Today, AI is embedded across organizations — screening candidates, flagging performance risks, personalizing learning paths and informing promotion decisions. These tools were implemented by IT, not HR. But when AI influences employment decisions, ownership doesn’t sit with the buyer of the software. 

It sits with HR. 

If AI influenced the decision, HR owns the risk, even if IT bought the tool.  

Where embedded AI creates hidden HR risk 

AI is now a built-in feature of core workplace systems. It’s baked directly into: 

  • Recruiting and applicant tracking systems 
  • Performance management and productivity tools 
  • Learning, skills and talent marketplaces 

These capabilities are switched on and bundled into platforms HR already uses, sometimes without HR’s formal review or sign-off. The result is a growing accountability gap between who deploys AI and who is legally responsible for its outcomes.  

If HR doesn’t know where AI is operating, it can’t manage bias, compliance, or legal defensibility. 

January’s reality check for HR 

Cautionary tales of AI-related job errors and growing concerns about discrimination hasten the need for strong guardrails, putting HR leaders under increasing pressure to ensure AI is embedded responsibly and strategically. Complicating matters, employees and managers may already be using AI in ways that are informal, untracked or not officially endorsed by leadership.  

As organizations head into the new year, HR leaders should take three practical steps: 

1. Inventory where AI or automation touches employment decisions 

Identify every point where algorithms influence hiring, promotion, performance, discipline or access to training, such as resume screening rules, performance flags or learning recommendations. 

2. Train HR, managers and employees on shared responsibility 

Vendor-provided tools do not transfer legal accountability. HR, managers and employees must understand what they are responsible for reviewing, documenting and escalating, including when human review is required. 

3. Set guardrails for documentation, bias escalation and human review 

AI should inform decisions, not replace human judgment. Clear processes for review and intervention are now table stakes for defensibility. 

Employers want AI skills, but not the downtime 

While AI risk accelerates, organizations often struggle with how to build AI capability without disrupting the business. 

Owning AI risk doesn’t just require governance; it requires fluency across the workforce. 

Pluralsight’s October 2025 Tech Skills Report reveals a widening gap between AI ambition and workforce readiness. It found that 95% of executives say a strong learning culture is a strategic priority, while an identical 95% of employees say they lack meaningful support to build new skills. 

The results show that the urgency to train is universal. Employers know what they need to teach, but not how to operationalize it. 

California’s new AI hiring rules signal a broader compliance wave 

On October 1, 2025, California’s Civil Rights Department activated new regulations governing the use of automated decision systems in employment. The rules require employers and vendors to: 

  • Disclose when algorithmic tools are used in hiring, promotion, or training selection 
  • Maintain documentation demonstrating that systems do not produce discriminatory outcomes under FEHA 

This marks the first statewide enforcement of algorithmic fairness in employment practices. 

AI literacy and oversight are no longer optional HR initiatives. They are now part of legal defensibility. Employers using automated tools must be able to demonstrate: 

  • Documented human oversight 
  • Bias mitigation processes 
  • Clear accountability for AI-influenced decisions 

This moves AI oversight out of policy documents and into daily HR operations. Documentation, training and review processes must now be audit ready. 

With enforcement expected to accelerate in 2026 — and other states already following California’s lead — compliance-driven training is moving from “nice to have” to non-discretionary. 

Organizations that succeed in 2026 and beyond will be the ones that: 

  • Treat AI oversight as a core HR and compliance responsibility 
  • Build AI skills without adding operational drag 
  • Invest early in defensible, auditable training and governance 

For HR leaders, the question is no longer whether AI is part of your employment decisions. It’s whether you’re prepared to own it, protect the organization and lead with confidence in an AI-enabled workplace.
