Failure to comply with FERPA obligations could result in loss of DOE funding.
FERPA does not explicitly state employee training as a requirement; however, the DOE considers employee training as a necessary condition of meeting FERPA obligations. As an example, FERPA states the following: “The Office may require a … recipient of Department funds … to submit… training materials … to carry out the Office's enforcement responsibilities under the Act.” (Authority: 20 U.S.C. 1232g(b)(4)(B), (f), and (g)) [76 FR 75643, Dec. 2, 2011].
Additionally, many states have created supplemental obligations and mandate employee training. The most comprehensive of these laws is California’s Student Online Personal Information Protection Act (SOPIPA). California’s DOE and Attorney General recommend FERPA-subject employees train on FERPA and SOPIPA obligations. Reel 5 covers California’s SOPIPA.
