WHAT’S REQUIRED

Employers with Five or More Employees

Sexual Harassment Prevention Training

California employers with five or more employees must provide legally compliant sexual harassment prevention training every two years.

Training requirements include:

  • Two hours of training for supervisors
  • One hour of training for non-supervisory employees
  • Training for new employees and newly promoted supervisors within required timeframes
  • Content addressing harassment, discrimination, retaliation, abusive conduct, complaint reporting and employer responsibilities

Employers should maintain records documenting completed training.

Workplace Violence Prevention Training

California’s Workplace Violence Prevention law (SB 553) requires most employers to establish a Workplace Violence Prevention Plan (WVPP) and provide workplace violence prevention training covering the plan and workplace-specific hazards.

Training generally includes:

  • The employer’s Workplace Violence Prevention Plan (WVPP)
  • Recognizing workplace violence hazards
  • Reporting procedures
  • Emergency response procedures
  • Employee rights
  • Hazard correction procedures

Training must be provided when the plan is implemented, to new employees and whenever workplace hazards or the plan change.

Certain California Industries

Industry-Specific Compliance Training

Some California employers have additional mandatory training obligations based on their industry.

  • Registered janitorial employers must provide sexual violence and harassment prevention training every two years.
  • Healthcare employers may have additional federal or state training requirements.
  • Education employers may have additional federal or state training requirements.
  • Long-term care employers may have additional federal or state training requirements.

California compliance training questions

California employers with five or more employees must provide sexual harassment prevention training every two years. Most California employers must also establish a written Workplace Violence Prevention Plan and provide workplace violence prevention training initially and annually under Labor Code Section 6401.9. Separate or additional requirements may apply to certain industries, workplaces and employee groups.

California employers with five or more employees must provide harassment prevention training every two years. Supervisors must complete two hours of training, while non-supervisory employees must complete one hour. New employees and newly promoted supervisors must also be trained within the required timeframes.

Yes. California permits classroom, webinar and e-learning formats, provided the training meets the state’s content, trainer and interactivity requirements. For e-learning, employees must be able to submit questions to a qualified trainer and receive a response within two business days.

Yes. Most California employers must provide workplace violence prevention training under SB 553. Employees must be trained when the Workplace Violence Prevention Plan is implemented, when they are hired and whenever new workplace hazards or changes to the plan require additional training.
