Annual Sexual Harassment Prevention Training

Every employer with employees working in Illinois must provide sexual harassment prevention training to all employees each calendar year. The training must meet or exceed the Illinois Department of Human Rights’ minimum standards. Employers must also retain records documenting completion.

Restaurants and Bars

Annual Industry-Specific Supplemental Training
Illinois restaurants and bars must provide two forms of annual training:

The supplemental program must cover situations such as harassment by customers, alcohol-related workplace interactions and power dynamics involving tipped employees.

The Chicago requirements apply in addition to the statewide Illinois mandate, although a course may satisfy both when it meets the applicable standards.

Illinois and Chicago compliance training questions

Every employer with employees working in Illinois must provide annual sexual harassment training to all employees. Additional requirements apply to restaurants, bars and to employees working within Chicago.

Employees must complete the training every calendar year. Employers must provide training by December 31 and maintain documentation showing completion. New employees should be trained as soon as possible after hire.

Chicago employees must receive at least one hour of sexual harassment prevention training and one hour of bystander intervention training annually. Supervisors and managers must receive at least two hours of harassment prevention training plus one hour of bystander intervention training annually.

Yes. Training that meets Chicago’s standards can also satisfy the statewide Illinois harassment prevention requirement. Chicago supervisors and managers need an additional hour of harassment prevention training, and all Chicago employees must receive a separate hour of bystander intervention training annually.

Yes. Restaurants and bars must provide annual statewide harassment prevention training and supplemental training addressing the restaurant and bar environment. They must also maintain a written sexual harassment prevention policy specific to the industry and provide it to employees.

Yes. Employers may use a third-party provider or their own program as long as the training meets or exceeds the applicable Illinois and Chicago standards.

Illinois employers must maintain records demonstrating that employees completed the required annual training. Records may include certificates, signed acknowledgements, employee emails or course sign-in sheets and may be maintained electronically or on paper. Chicago employers must retain required training records for at least five years.
