On May 6, 2022, substantial changes to Cal/OSHA’s COVID-19 Prevention Emergency Temporary Standard (ETS) took effect. The changes, which are in effect until December 31, 2022, govern all California employers not subject to the Aerosol Transmissible Diseases Standard.
Important changes include deferring to mask guidance from the California Department of Public Health and the removal of all cleaning requirements for workplaces. Some definitions and standards for testing and exclusion were also changed.
Many important requirements have remained the same, however. Employers must still have effective COVID-19 Prevention Plans and provide training on COVID-19 prevention to all California employees. OSHA also continues to urge all employers nationwide to train employees on COVID-19 prevention.
Even with the recent changes, California employers are still required to provide COVID-19 safe workplace training. Cal/OSHA’s COVID-19 Prevention Emergency Temporary Standards (Cal/OSHA Standards) require employers to “provide effective training and instruction to employees” on a number of specifically identified topics.
